I.- OWNERSHIP OF THE PORTAL

PARQUES REUNIDOS SERVICIOS CENTRALES, S.A.(henceforth, “PARQUES REUNIDOS”) with registered address at Madrid, Paseo de la Castellana 216, planta 16 and C.I.F. A-84.885.441. Inscribed in the Mercantile Registry of Madrid at Tomo 23.506, Folio 58, Hoja M – 421.702. is the owner of the portal www.parquewarner.com, (henceforth, the “Portal”) and makes it available to Internet Users so as to furnish information to them about the products and services of both PARQUES REUNIDOS and its affiliates (henceforth, “GRUPO PARQUES REUNIDOS”), as well as to allow provision of various purchase services for entry tickets and season tickets through the Portal, or of any other class of product through the Portal as well as, where relevant, to make different competitions, games, surveys, etc, available to Users.

For the foregoing purposes, the identifying data and contact data for Madrid Theme Park Management, S.L.U. the company that operates through the Portal and is responsible for management of the Park (henceforth, the “Park”), and therefore, responsible for the sale of all products and/ or services related to the Park, are the following:

II.- GENERAL TERMS OF SALE

The present General Terms of Sale shall regulate expressly the relations arising between GRUPO PARQUES REUNIDOS and the Users who may contract the provision of the services or products offered through the Portal.

The present General Terms have been prepared in accordance with the Law 34/2002, on the information society and electronic commerce, the Law 7/1998 on General Terms of Sale, the Legislative Royal Decree 1/2007, of 16 November, which approved the consolidated text of the General Law on the RIghts of Consumers and Users and other complementary laws, the Law 59/2003, of 19 December, on digital signatures, and such other legal provisions that may be applicable.

This document is accessible at all times in the online purchasing section of the Portal of PARQUES REUNIDOS and may be printed and stored by the User.

1. PRE-PURCHASE INFORMATION

These General Terms of Sale have the object of regulating the general conditions for provision of the services offered by GRUPO PARQUES REUNIDOS through www.parquewarner.com. The services currently provided by GRUPO PARQUES REUNIDOS and which are the object of contracts with Users are the sale of certain kinds of entry tickets and season tickets for the leisure parks managed by GRUPO PARQUES REUNIDOS, and any other products offered through the Portal.

The products and services offered by GRUPO PARQUES REUNIDOS may be contracted by any Users who reside in Spain or another Member State of the European Union or the European Economic Area, and also by any Users not resident in a Member State of the European Union or European Economic Area, to whom in which latter case the law of Spain shall be applicable.

The entry tickets and season tickets service of GRUPO PARQUES REUNIDOS and any other products or services offered by the Portal are paid services, and the prices of the same, including taxes, are specified at all times in the Portal.
Access to the information in the Portal does not entail any kind of payment.

The User understands that the information contained in the Portal, the general information about tickets and season tickets, and other products offered therein, and the General Terms of Sale, and the particular conditions of each contract, are sufficient to exclude any possibility of error in the provision of User consent.

1.1 Procedures

To proceed to use the different purchase services offered by the Portal, the User must follow at all times the indications and instructions on the screen (PURCHASE), completing the information required by the forms presented to them, this in turn entailing the prior reading and acceptance of all the General Terms of Sale stated therein, and the User hereby declares that they recognise and accept the said procedures as necessary for access to the offer of the PURCHASE section of the Portal.

The User shall formalise their purchase by completing all the phases established by the PURCHASE section and electronic notification. The present General Terms of Sale shall form an integral part of the contract with the User from the moment of its express acceptance by the same, as manifested through the completion and remittance of the purchase data introduced in the PURCHASE section.

The use of any of the services of the Portal entails the acceptance by the User without any kind of reservation, of each and every one of the General Terms of Use of the Portal and the General Terms of Sale and, if relevant, of the Particular Terms of Sale which are put at the disposal of the User prior to the formalisation of their purchase and which regulate the acquisition of the tickets or season tickets or any other product or service offered by the Portal.

1.2 Documentation and language

The present General Terms of Sale are accessible at all times in the PURCHASE section online of the Portal of PARQUES REUNIDOS and may be printed and stored by the User.

In the case of entry ticket purchase, after concluding the purchasing process, the User shall receive a purchase voucher (the Ticket), with a barcode which shall serve as ticket to the premises of the selected leisure park. This Ticket may not be photocopied, manipulated or damaged, which would lead to its immediate cancellation.

The ticket purchased through the Portal for a particular date shall be valid only for that said date, except when it is acquired with minimum advance notice of seven days, in which case it may be used on the chosen date, which shall never be a Sunday or Wednesday, or on any of the seven days following the chosen date, although only within the season then under way (the Flexi-Ticket).

Should the tickets not be acquired for a specific date, they shall remain valid for use for within the four (4) months following the date of purchase, while again only within the corresponding opening season for the Park.
In the case of purchase of season tickets or any other kind of product/ service offered via the Portal other than entry ticket purchase, the User shall likewise get a receipt by email. LIkewise, the Portal shall inform Users of the Particular Terms of Sale applicable to each purchase prior to formalisation.

By the issue of the Ticket it shall be understood that all the requirements pursuant to Royal Decree 1619/2012, of 30 November, which approved the Regulations that govern invoicing obligations, have been fulfilled insofar as they relate to the availability of the document takes the place of the invoice.

Once the purchase process made available at the Portal has concluded, and the corresponding Ticket has been obtained, no exchanges or refunds shall be accepted
The present General Terms of Sale are written in Spanish (Castilian).

1.3 Technical means

The Portal shall put all the technical means necessary to identify and correct errors in the completion of the different forms that appear on the screen during the purchasing process.

1.4 Modification of the General Terms of Sale

GRUPO PARQUES REUNIDOS reserves the right to modify the present General Terms of Sale, or where relevant, the Particular Terms of Sale that may be applicable, and any other general or particular conditions, regulations for use or warnings that may be applicable, at any time. The duty to notify Users shall be deemed fulfilled by modification of the General and/ or Particular Terms of Sale displayed at the Portal of PARQUES REUNIDOS.

In any case, before contracting any product or service, the General Terms of Sale and/ or Particular Terms of Sale that may be applicable, may be consulted. Likewise, the presentation, configuration and location of the Portal, and the content and Terms of Use of the same, may be modified at any time. 

2. PROTECTION OF PERSONAL DATA

The personal data provided by Users during the purchase or request for services offered on the Website and any other data generated subsequently as a result of their relationship with us will be included in files for which (i) Madrid Theme Park Management, S.L.U. (with registered office in Paseo de la Castellana 216, planta 16,28046 Madrid, Spain; email: lopd@grpr.com) and (ii) its parent company, Parques Reunidos Servicios Centrales, S.A. (registered in Paseo de la Castellana 216, planta 16,28046 Madrid, Spain; email: lopd@grpr.com) are co-responsible (the “Controllers”). The data will be processed by the Controllers for the development, maintenance and control of the relationship of Users with us and, in particular, to manage their purchase of ticket or other products, the provision of services requested by Users or their participation in the promotion, survey or specific game for which they have given us their data and to process requests that Users address to us, to keep communications to improve our services and for statistical purposes.

The users shall check the box on the form which facilitates their data, authorizing Controllers to use their personal data for surveys, sending communications for purposes of advertising, promotions and consumer studies by any means ( including electronic means or fax communication) relating to products or services in the leisure industry (leisure parks sector and, where appropriate, the hotel industry). This authorization includes the power of Controllers or third parties (to whom Controllers will under no circumstance transfer personal data of Users) to determine the parameters of the target audience of these informational or promotional campaigns.

To exercise their rights of access, rectification, cancellation and opposition provided by law, Users must send a written request in writing to the Controllers to the address or email indicated in this clause, indicating on the subject “ARCO Request- Marketing Department” and attaching a copy of the document proving their identity.

3.. MINORS

USERS UNDER 14 YEARS OF AGE NEED PARENTAL CONSENT. To this end, we will contact them and ask them to confirm they are the parents or guardians and once we have their consent, we can then accept your request.

III.- PARTICULAR TERMS OF SALE

1.  Particular Terms of Sale “Any Date” Tickets

  1. The User must print their ticket on any jet, inkjet or laser printer, in colour or black and white, to be able to enter the Park. The printed Ticket should be brought directly to the Park turnstiles. To obtain the special prices for large families, seniors or the disabled (at least 33% disability), among others, this entitlement must be duly accredited at the Park Ticket Office.
     
  2. This Ticket is valid for any one day of the 2015 season, and shall subsequently be invalid. Please consult the calendar and opening hours at www.parquewarner.com or by calling 902 345 001.
  3. Purchase and use of any article sold online entails complete acceptance of the online Terms of Sale as well as the rules of the Park.
     
  4. This cannot be combined with other offers or discounts. No exchanges or refunds will be granted.
     
  5. The User must not cut, damage, impair or photocopy the Ticket. In any of these circumstances, access to the Park might be denied.
     
  6. Each Ticket bears a unique barcode that permits ONLY ONE ENTRY into the Park. Once validated it may not be used on a later occasion.
     
  7. The User must not lose the Ticket. It should be retained by the User throughout their stay in the Park and shown to any employee on request.
     
  8. Resale to third parties is prohibited.
     
  9. Should the User commit some kind of error in purchasing (for instance, Tickets for children instead of adults, Tickets for the wrong day, etc), they should ask for the appropriate change at the Park Ticket Office and make any extra payment required. For these purposes, the reference price shall be taken as the official price of public sale (PVP) at the main entrance (29.90 €) and not the advance price stated at the Portal, and the User must pay the difference of prices where relevant. Likewise, where applicable, any difference that may arise in the User’s favour shall be reimbursed by bank transfer to the account indicated by the User for the purchase at the Portal.
     
  10. We reserve the right to close the Park without warning for reasons of adverse weather, overcrowding or public safety.
  11. Promotion Day 2: The user can find out at the office of "second day" in the office or Customer's Park.

2. Particular Terms of Sale “Specific Date” Tickets (including Flexi-Tickets)

  1. The User must print their ticket on any jet, inkjet or laser printer, in colour or black and white, to be able to enter the Park. The printed Ticket should be brought directly to the Park turnstiles. For the special prices for large families, seniors or the disabled (at least 33% disability), among others, this entitlement must be duly accredited at the Park Ticket Office.
     
  2. This Ticket is valid EXCLUSIVELY on the day stated at the top “Date of Validity”, UNLESS it is acquired with minimum advance notice of seven days, in which case it may be used on the chosen date, which shall never be a Sunday or Wednesday, or on any of the seven days following the chosen date, although only within the season then under way (the Flexi-Ticket).

  4. Purchase and use of any article sold online entails complete acceptance of the online Terms of Sale as well as the rules of the Park.
     
  5. This may not be combined with other offers or discounts (not even for Flexi-Tickets). No exchanges or refunds will be granted (not even for Flexi-Tickets).
     
  6. The User must not cut, damage, impair or photocopy the Ticket. In any of these circumstances, access to the Park might be denied.
     
  7. Each Ticket bears a unique barcode that permits ONLY ONE ENTRY into the Park (including Flexi-Tickets). Once validated it may not be used on a later occasion.
     
  8. The User must not lose the Ticket. It should be retained by the User throughout their stay in the Park and shown to any employee on request.
     
  9. Resale to third parties is prohibited.
     
  10. Should the User commit some kind of error in purchasing (for instance, tickets for children instead of adults, tickets for the wrong day, etc), they should ask for the appropriate change at the Park Ticket Office. For these purposes, the reference price shall be taken as the official price of public sale (PVP) at the main entrance (29.90 €) and not the advance price stated at the Portal, and the User must pay the difference of prices where relevant. Likewise, where applicable, any difference that may arise in the User’s favour shall be reimbursed by bank transfer to the account indicated by the User for the purchase at the Portal.

  12. Promotion Day 2: The user can find out at the office of "second day" in the office or Customer's Park.

3. Particular Terms of Sale Tickets “Menu Online”

  1. The printed sheet for the menu option chosen by the User shall be exchanged for a meal made up of: (i) “Fast Food Menu”, to be chosen from Big Burger, Kids’ Pasties, Home-made Sandwich, Pizza slice or Kebab (including chips and a normal drink) or (ii) “Hot Dog Menu”, which is a hot dog accompanied with chips and drinks or (iii) “Buffet Libre Menu” (no drink included), depending on the online transaction chosen earlier by the User. The Ticket should not be lost: it will be required at the moment of exchange at the eating-place. If for reasons outside the control of the Catering department, it is not possible to offer what was advertised, it will be substituted for a product similar or superior to that offered.
  2. Purchase and use of any article sold online entails complete acceptance of the online Terms of Sale as well as the rules of the Park.
     
  3. This may not be combined with other offers or discounts. No exchanges or refunds will be granted.
     
  4. The User must not cut, damage, impair or photocopy the Ticket. In any of these circumstances, access to the Park might be denied.
     
  5. Each ticket has a unique barcode that entitles the bearer to a TIcket-Menu for a single use at the Park.
     
  6. Resale to third parties is prohibited.
     
  7. This product is additional and therefore is not included in the Park entry ticket.
     
  8. The Ticket-Menu corresponding to the (i) “Fast Food Menu” and the (ii) “Hot Dog Menu”, may be exchanged at any of the kiosks of the Park and (iii) the “Buffet Libre Menu”, may be exchanged at the “Buffet Libre Gran Avenida”, between 1 pm and 4 pm (Saturdays, Sundays and holidays), always subject to the named eating-places being open. Access to the installations of the “Buffet Libre Gran Avenida” shall be restricted exclusively to those Users who have purchased a “Buffet Libre Menu”, no access to those who have purchased a different meal being permitted.
     
  9. We reserve the right to close the eating-places without warning for reasons of adverse weather, overcrowding or public safety.
  10. Promotion Day 2: The user can find out at the office of "second day" in the office or Customer's Park.

The present Particular Terms of Sale may be modified at any moment by PARQUES REUNIDOS and/ or the company managing the Park. For further information please see parquewarner.com.

IV. LEGISLATION APPLICABLE

The present Particular Terms of Sale shall be governed by the law of Spain, which shall be of application in all matters beyond the scope of this contract in relation to the interpretation, validity and execution of the same.
